Access to the “la Caixa” portal and to the information on any of the products or services contained therein implies acceptance of the conditions set forth in this Legal Notice. We therefore recommend that you read the contents of this notice carefully should you wish to access and make use of the information and services offered through the “la Caixa” portal.

Validity of information

These conditions are valid from the date of the last site update. “la Caixa” reserves the right to amend them at any time, and any amendment will become effective from the time of its publication and will apply to all the users of the portal from such date onwards.

The contents of this portal, particularly information and advertising references, unless expressly stated otherwise, do not constitute a binding offer. “la Caixa” reserves the right to modify or partially or fully remove the current contents of the “la Caixa” portal if and when it sees so fit, and to prevent or restrict access on a temporary or permanent basis.

Privacy and data protection policy

”la Caixa” fully complies with prevailing data protection legislation and with the confidentiality commitments specific to banking activity.

”la Caixa” has adopted the necessary technical measures to maintain the required level of security in accordance with the nature of the personal data being handled and the conditions of their handing, in order to avoid, to the furthest extent possible using state-of-the-art means, the alteration, loss or unauthorised treatment or access of personal data.

When users or customers are requested to fill in a form stating personal details, they shall be informed as to the purpose of the data gathering, the identity and registered address of the body responsible for holding the data file and the user’s rights to access, rectify, cancel or object to the treatment of their data. Personal data gathered shall not only be treated and/or granted with an express purpose and always with the consent of the user or customer.

In order to keep the data in our files up to date and error-free at all times, we ask our customers and users to notify us immediately in the event of any modifications or rectifications to their personal data.

Some pages of the “la Caixa” portal use cookies, i.e. small data files generated on the system of the user or customer which enable our systems to save the selected language and portal, along with other customised features or browsing preferences set by the user in his/her first session. ”la Caixa” does not express any guarantee as to the lawfulness and legality of the information or elements contained in the portal pages when the ownership thereof does not correspond to ”la Caixa” or to its Group companies.

Prohibited and permitted uses

Any use of portal contents, creations and distinctive emblems, including all types of reproduction, distribution, transfer to third parties, public disclosure and transformation via any format or medium, is prohibited unless expressly authorised by their corresponding owners. Failure to comply with this prohibition may constitute a punishable offence under prevailing legislation.

Under no circumstances does this grant authorisation or licence over the ownership rights of “la Caixa” or its Group companies.

The creation of links or hyperlinks from the portals or websites of third parties to webpages in the “la Caixa” portal other than the homepage (accessible through the URL: http://www.lacaixa.es or any other URL that may replace this in the future), and the presentation of the webpages of “la Caixa” or the information contained therein as frames, distinctive emblems, brands, or company or commercial names of another individual, company or entity, are prohibited, except when expressly authorised by ”la Caixa”.

Liabilities

”la Caixa” does not guarantee continuous access or correct display, downloading or use of the elements and information contained on the pages of the ”la Caixa” portal, which may be hindered, hampered or interrupted by factors or circumstances beyond its control .

”la Caixa” will not be held liable for either the information and other contents included on the sites or webpages of third parties that may be accessed from the portal of ”la Caixa” by means of links or hyperlinks, or the information and other contents included on the sites or webpages of third parties from which access has been gained by means of links or hyperlinks to the portal of ”la Caixa” or any of its webpages, or for the information and contents of any third party web page presented using the appearance or distinctive emblems of ”la Caixa”, except by express authorisation from ”la Caixa”.

”la Caixa” and its data providers as third parties do not accept any liability regarding the information, contents of any kind, products or services offered or render through the la Caixa” portal by third parties or entities, even if they belong to its business Group and, particularly, for damages and loss of any kind which, in relation to the above, could arise as a result of: (i) absence of or weaknesses in the information provided to the users or its veracity, accuracy and sufficiency; (ii) failure to comply or untimely or inaccurate compliance with contracts and pre-contractual relations (iii) failure to comply with the obligations required of IT service providers; (iv) breach of consumers’ and users’ rights; (v) breach of intellectual and industrial property rights, undertaking of unlawful competition or illicit advertising; (vi) breach of the right to data protection; professional secrecy and rights to honour and personal and family privacy and personal images; (vii) in general, failure to comply with any applicable law, custom or code of conduct, and (viii) any decision taken based on the information provided through the “la Caixa” portal.

Neither “la Caixa” nor its data providers as third parties accept any liability for damage, loss, claims or expenses that may arise as a result of: (i) interference, interruptions, faults, omissions, telephone breakdowns, delays, blockages or disconnections in the operations of the electronic system, whether caused by defects, overloads and errors in telecommunications lines and networks, or by any other factor beyond the control of ”la Caixa”; (ii) illegitimate interference caused by the use of malware of any kind and by any means of communication, such as computer viruses or any other; (iii) improper or inappropriate use of the ”la Caixa” portal, or: (iv) security or navigation errors prompted by malfunctioning of the browser or the use of non-updated versions thereof.
